Giffen & Kaminski prosecutes and defends will contest
cases, concealment of assets cases, and claims for breach
of fiduciary duties by executors and trustees. Most of these
cases have arisen under Ohio's Probate Code and thus, have
included procedural and practical complexities peculiar to
the Probate Court. In addition, Giffen & Kaminski has defended against claims to remove trustees and have sought
declaratory judgments in order to construe the provisions
of a trust. Finally, Giffen & Kaminski has been involved
in obtaining guardianships.
